1. Acceptance of Terms

By creating an account, accessing, or using the Uptify platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our services.

2. User Accounts & Responsibilities

When registering, you must provide accurate, current, and complete information. You are solely responsible for safeguarding your credentials, session tokens, and developer API keys. Any action taken through your account credentials remains your responsibility.

3. Acceptable Use Policy & Probing Restrictions

You agree to use Uptify in accordance with all applicable laws and regulations. You specifically agree that you will NOT:

Configure uptime checks or ping targets for servers, networks, or endpoints that you do not own or do not have explicit authorization to monitor.
Use the probing network to launch or amplify Distributed Denial of Service (DDoS) attacks, flood target ports, or conduct vulnerability penetration testing without authorization.
Post illegal, infringing, harassing, defamatory, or abusive content on public Feedback Boards or Documentation Studios.
Attempt to reverse-engineer, exploit, or bypass authentication, rate-limiting, or token verification mechanisms.

4. Service Availability & Uptime Disclaimer

While Uptify utilizes multi-region nodes to deliver high-availability monitoring, the platform is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that monitoring checks will be uninterrupted, error-free, or that alert deliveries via external third parties (such as Discord or third-party mail exchanges) will never be subject to network latency or transit delays.

5. Credits, Digital Goods & Refunds

Platform features such as additional monitor capacity, fast-frequency intervals, and custom domain slots can be acquired via computing credits. Virtual credits and feature provisioning are governed by our Refund & Cancellation Policy.

6. Intellectual Property & User Content

You retain full ownership of the documentation guides, logos, status descriptions, and roadmap feedback you post on your Uptify project spaces. Uptify retains all rights, title, and interest in and to the platform codebase, branding, designs, and APIs.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Uptify or its operators be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from platform downtime or alert misdeliveries.
